By accessing or using Magic Money Funnel ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Platform. These terms apply to all users, including administrators, brand owners, and any individuals who access the Platform.

Magic Money Funnel is a SaaS checkout funnel platform that enables brand owners to build, test, and optimize multi-step sales funnels. Features include funnel builder tools, A/B testing, design system management, subscriber analytics, and integrations with third-party payment processors.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with or without notice.

To use the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept all risks of unauthorized access to your account
• Promptly notify us if you discover or suspect any security breaches related to your account
• Be responsible for all activities that occur under your account

Access to the Platform is provided on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the rate for your selected plan until you cancel. You can cancel at any time from Settings → Billing (or via the billing portal); cancellation takes effect at the end of the current billing period and stops all future charges. All fees are stated in USD and are non-refundable except as required by law or as explicitly stated in our refund policy.

We may change subscription pricing with at least 30 days' notice. Your continued use of the Platform after a price change constitutes your agreement to the new pricing.

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial period ends. No credit card is required to begin a trial where specified.

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Sell, promote, or distribute illegal products or services
• Engage in deceptive, misleading, or fraudulent marketing practices
• Send unsolicited communications (spam) to any individual
• Infringe on intellectual property rights of any third party
• Attempt to gain unauthorized access to any portion of the Platform or its related systems

Violation of acceptable use policies may result in immediate suspension or termination of your account.

Buyer payments on your funnels are processed through Stripe Connect: you connect your own Stripe account, and every sale runs on that account — you are the merchant of record for your sales, and payouts, refunds, chargebacks, and taxes on those sales are between you, Stripe, and your customers. The Platform never stores your Stripe secret keys and never holds your buyers' card numbers; card data is entered directly with Stripe. Your use of Stripe is governed by Stripe's own terms, including the Stripe Connected Account Agreement. Magic Money Funnel is not a payment processor, money transmitter, or party to your sales, and assumes no liability for payment processing errors, fraud, or disputes between you and your customers.

You retain full ownership of your brand content, funnel copy, and customer data entered into the Platform. By using the Platform, you grant us a limited, non-exclusive license to host and process your content solely for the purpose of providing the service. You are responsible for ensuring your content complies with applicable laws, including consumer protection regulations (such as auto-renewal disclosure requirements for subscriptions you sell), advertising standards (including earnings-claim rules), and privacy regulations.

Where we process personal data of your buyers and leads on your behalf, our Data Processing Agreement applies and is incorporated into these Terms by reference. Our current subprocessors are listed here.

The Platform, including all software, design, text, graphics, and other content created by Magic Money Funnel, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written consent.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC MONEY FUNNEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Either party may terminate the agreement at any time. You may cancel your account through the platform settings. We reserve the right to suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to access the Platform ceases and we may delete your data in accordance with our data retention policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Oklahoma, and each party consents to personal jurisdiction and venue in those courts.

We reserve the right to update these Terms at any time. We will provide notice of material changes by email or by posting a prominent notice on the Platform. Your continued use of the Platform after changes become effective constitutes your acceptance.
